These Terms of Use apply to the website operated by Mend Health Solutions LLC, doing business as Mend Medical Care (“Mend,” “Mend Medical Care,” “we,” “us,” or “our”), including mendmedicalcare.com and its related webpages, online forms, scheduling features, patient-facing tools, and other online services.
Please read these Terms carefully. By accessing or using the website, you agree to these Terms. If you do not agree, please do not use the website.
1. About Mend Medical Care
Mend Medical Care provides general medical care through in-person visits, including house-call services when available, and telehealth visits.
Our services are provided by licensed healthcare professionals who exercise independent clinical judgment. Services are available only where the treating professional is licensed or otherwise legally authorized to provide care.
Not every service is available in every location or appropriate for every patient.
2. Website Information
This website provides general information about Mend Medical Care and may allow you to:
- Learn about our services.
- Request or schedule an appointment.
- Submit basic contact or intake information.
- Access a patient portal or telehealth platform.
- Make a payment.
- Communicate with our administrative staff.
- Enroll in an available program or membership.
Information on the public website is intended for general educational and informational purposes. It is not individualized medical advice and does not replace an examination, diagnosis, treatment plan, or direct communication with a qualified healthcare professional.
3. Medical Emergencies
Do not use this website, email, text messaging, an online form, or a patient portal message for a medical emergency.
If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency department.
Mend Medical Care does not provide emergency medical services through its website or messaging systems.
4. No Continuous Monitoring
Mend Medical Care does not continuously monitor website submissions, portal messages, email, text messages, wearable-device information, laboratory results, glucose-monitor data, or other health information.
Information is generally reviewed during scheduled visits, during normal administrative workflows, or as otherwise communicated to you.
Unless Mend has expressly agreed to a different response time in writing:
- Messages are not monitored 24 hours a day.
- Immediate responses are not guaranteed.
- Mend does not provide continuous remote patient monitoring.
- You should not rely on electronic communication for an urgent or time-sensitive medical concern.
Contact 911, an emergency department, or another appropriate medical service when immediate attention is needed.
5. Provider-Patient Relationship
Merely visiting this website, reading its content, submitting a form, sending a message, or requesting an appointment does not automatically create a provider-patient relationship.
A provider-patient relationship is established only after Mend Medical Care accepts you as a patient and a licensed healthcare professional begins providing care.
Mend Medical Care may decline an appointment request or determine that a requested service is not appropriate.
6. Separate Patient Agreements
These Terms govern use of the website and related online services. They are not a substitute for the documents used in connection with medical care.
Before or during treatment, you may be required to review or sign separate documents, including:
- Consent to treatment.
- Telehealth informed consent.
- HIPAA Notice of Privacy Practices.
- Financial and cancellation policies.
- Membership or subscription agreements.
- Medication-specific consent forms.
- Laboratory, diagnostic, hormone, infusion, injection, or procedure-specific consent forms.
- Authorizations for the use or disclosure of medical information.
When a separate patient agreement applies to a particular medical service, that agreement will control over these website Terms concerning that service.
7. Telehealth Services
Telehealth may be offered when the treating healthcare professional determines that it is clinically appropriate and legally permitted.
Before receiving telehealth services, you may be required to:

- Confirm your current physical location.
- Provide informed consent for telehealth.
- Provide accurate medical and contact information.
- Use a reasonably private location.
- Maintain an appropriate telephone or internet connection.
- Provide an emergency contact when requested.

Telehealth has limitations. Potential limitations include:
- An inability to perform a complete hands-on physical examination.
- Poor audio, video, image, or connection quality.
- Technology failures or interruptions.
- Delays caused by technical problems.

- The possibility that an in-person examination, laboratory test, imaging study, or specialist evaluation will be needed.
Telehealth is not appropriate for every medical condition.
A Mend Medical Care provider may stop or decline a telehealth visit and recommend in-person, urgent, emergency, or specialist care when appropriate.
8. Medical Decisions and Treatment Results
Medical decisions are made by the treating healthcare professional based on clinical judgment, the information reasonably available, applicable standards of care, and federal and state law.
Mend Medical Care does not guarantee:
- A particular diagnosis.
- A prescription.
- A laboratory or imaging order.
- A referral.
- Eligibility for a particular treatment.
- Insurance coverage.
- A particular medical, cosmetic, wellness, or performance outcome.
Results vary between patients. No information on the website should be interpreted as a promise or guarantee of improvement.
9. Prescriptions and Medication Requests
Requesting a medication does not guarantee that it will be prescribed.
A healthcare professional may require an examination, identity verification, medical-record review, laboratory testing, diagnostic testing, follow-up visit, or in-person evaluation before prescribing or continuing a medication.
Prescriptions will be issued only when the treating healthcare professional determines that the medication is clinically appropriate and legally permitted.
Certain medications, including controlled substances, are subject to additional federal and state requirements. These medications may require an in-person evaluation, identity verification, review of Arizona's Controlled Substances Prescription Monitoring Program, or other safeguards, and some medications may not be prescribed through telehealth.
Mend Medical Care may decline to prescribe, refill, or continue a medication when:
- The medication is not clinically appropriate.
- Required laboratory testing or follow-up has not been completed.
- Necessary medical information has not been provided.
- The medication cannot legally or safely be prescribed through telehealth.
- There are concerns regarding drug interactions, contraindications, misuse, diversion, or patient safety.
- An in-person evaluation is needed.
Medications must be used only as directed and must not be shared with another person.
10. Your Responsibilities as a Patient
When requesting or receiving services, you agree to:
- Provide truthful, complete, and current information.
- Disclose your medical history, medications, supplements, allergies, and prior adverse reactions.
- Notify your provider of significant changes in your health.
- Report medication side effects or treatment complications promptly.
- Follow medication instructions and reasonable treatment recommendations.
- Complete required laboratory testing and follow-up visits.
- Ask questions when instructions are unclear.
- Seek emergency or in-person care when advised.
- Keep your contact, pharmacy, and payment information current.
Healthcare professionals rely on the information you provide. Incomplete or inaccurate information may affect the safety and effectiveness of your care.
11. Appointments and Scheduling
Submitting an appointment request does not guarantee that an appointment has been scheduled or accepted.
An appointment is confirmed only after you receive confirmation from Mend Medical Care or its authorized scheduling system.
Appointment availability, service areas, provider availability, and response times may change.
Late cancellations, missed appointments, or appointments rescheduled without sufficient notice may be subject to a fee under the cancellation policy provided during scheduling or registration.
12. Children and Minor Patients
Mend Medical Care may provide services to minor patients when clinically appropriate and legally permitted.
A parent, legal guardian, or other legally authorized representative must generally request services and provide required consent for a minor.
The public website is not intended for a child to independently create an account, schedule services, submit medical information, or enter into a payment obligation without appropriate adult involvement.
13. Payment Model and Patient Financial Responsibility
Mend Medical Care is a cash-pay (direct-pay) medical practice. We do not participate in insurance networks, and we do not bill health insurance plans on your behalf.
Payment is due at the time of service unless a different arrangement is stated in an applicable membership, program, or financial agreement.
Upon request, Mend Medical Care may provide a receipt or itemized statement (sometimes called a “superbill”) that you may choose to submit to your insurance plan for possible out-of-network reimbursement. Mend Medical Care does not guarantee that your plan will reimburse any amount, and we do not submit claims, respond to insurer inquiries, or appeal claim denials on your behalf.
If you are a Medicare beneficiary or are enrolled in another federal or state health program, federal or state rules may limit or affect the services Mend Medical Care can provide to you on a cash-pay basis. Please contact us with questions before scheduling.
In accordance with federal law, uninsured and self-pay patients may request a Good Faith Estimate of the expected charges for scheduled services.
You are responsible for all fees for the services you receive. Amounts displayed on the website are estimates or current listed prices unless expressly identified as a binding quote.
14. Memberships and Recurring Programs
Mend Medical Care may offer concierge memberships, wellness programs, treatment programs, or other recurring services.
A membership is not health insurance and is not a substitute for health insurance. Membership fees are not insurance premiums.
Membership benefits, included services, exclusions, pricing, billing frequency, renewal terms, cancellation procedures, and refund terms will be provided in a separate membership or enrollment agreement.
By enrolling in a recurring program, you authorize the payment method you provide to be charged according to the terms presented at enrollment.
You may cancel a recurring program according to the cancellation procedure stated in the applicable membership or enrollment agreement.
If a membership agreement conflicts with this section, the membership agreement will control.
15. Laboratories, Imaging, Pharmacies, and Outside Services
Mend Medical Care may coordinate with laboratories, pharmacies, imaging facilities, specialists, hospitals, payment processors, or other outside organizations.
These organizations are separate entities and may:
- Charge their own fees.
- Bill your insurance separately.
- Require separate consent or registration.
- Apply their own terms and privacy policies.
- Make independent decisions regarding service availability.
Unless expressly stated otherwise, fees charged by outside organizations are not included in Mend Medical Care's visit, program, or membership fees.
You generally retain the right to select your pharmacy, laboratory, imaging facility, or specialist, subject to insurance requirements, availability, legal restrictions, and clinical considerations.
16. Payments and Pricing Errors
You agree to provide accurate and authorized payment information.
When you authorize a payment, you represent that you are authorized to use the payment method provided.
If a service is listed with an incorrect price because of a typographical, technical, or administrative error, Mend Medical Care may correct the error before providing the service.
If an incorrect amount has already been charged, Mend Medical Care will make an appropriate correction, credit, or refund.
Refund eligibility for medical services, memberships, products, deposits, or canceled appointments is determined by the applicable financial, cancellation, or membership policy and applicable law.
17. Electronic Communications
Mend Medical Care may communicate with you by telephone, voicemail, email, text message, patient portal, telehealth platform, or another electronic method.
By providing your contact information, you authorize Mend Medical Care and its service providers to send communications related to:
- Appointment scheduling and reminders.
- Patient registration.
- Care coordination.
- Laboratory or prescription matters.
- Billing and payment.
- Membership administration.
- Practice operations.
- Other healthcare or administrative matters.
Message and data rates may apply. Message frequency varies.
You may opt out of nonessential text messages by replying STOP when that option is available, and you may reply HELP for assistance. Opting out may limit our ability to provide appointment reminders or other convenient communications.
Ordinary email and text messaging may not be fully secure. Do not send highly sensitive medical information through a public contact form, ordinary email, or text message unless specifically instructed to do so.
18. Electronic Signatures
When you electronically sign a form, click a button indicating agreement, or otherwise provide electronic consent, your electronic action may have the same effect as a handwritten signature to the extent permitted by law.
You are responsible for reviewing a document before electronically accepting or signing it.
19. Patient Portals and Online Accounts
Some services may require access to a patient portal, scheduling platform, payment platform, or password-protected account.
You agree to:

- Keep passwords and verification codes confidential.

- Notify Mend Medical Care promptly if you suspect unauthorized access.

Mend Medical Care may suspend or terminate access when necessary to protect security, privacy, patients, staff, or website operations.

26. Limitation of Liability for Website Use
To the fullest extent permitted by law, Mend Medical Care will not be responsible for indirect, incidental, special, or consequential damages arising solely from:

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, a legal proceeding arising solely from use of the public website must be brought in a court with appropriate jurisdiction in Coconino County, Arizona.
This section does not alter the legal standards, rights, or procedures that apply to claims involving professional healthcare services.
29. Severability

The remaining provisions will continue in effect.
30. No Waiver
If Mend Medical Care does not immediately enforce a provision of these Terms, that does not waive its right to enforce the provision later.

These Terms, the Website Privacy Policy, and any policies expressly incorporated into these Terms constitute the agreement between you and Mend Medical Care regarding use of the public website.
Separate patient, financial, telehealth, consent, and membership agreements remain independently applicable to the services they cover.
